Question
I am going to do a do-it yourself divorce, and I want to know, since my husband is in jail, can I still proceed with doing this without his knowledge? Also, we have three children!

Answer
Dear Angela,

I am not so familiar with divorce when one party is incarcerated. Generally your spouse is "served" divorce papers and which time they have a certain number of days to respond. I would be careful using a do-it-yourself divorce kit as there is generally little state specific info as well as info relating to children. I would recommend that you have a local family law attorney review it to make sure you and your children are completely covered. This way you can be fairly certain that when you ex is released from prison, he cannot take you to court.
