Drawing/Calligraphy/Cartooning - Selling Caricatures of Celebrities

Expert: Elgin Bolling - 7/1/2009

Question
I would to sell the celebrities caricatures that I have drawn. However, I am concerned about the issue of right of privacy/publicity. I think even if I attempt to ask for the celebrities' permission to be drawn, my request will most likely be rejected or ignored. Is there any way I can do this without violating any regulations?

Answer
I admit to not being clear on this issue. The copyright issue DOES become sticky and sometimes complicated. Its one of the reasons why I shy away from drawing celebrities.
It would be my GUESS that you are in violation of copyright especially if your drawing is based on a photo that was made by a photographer, whose work IS copyrighted. You would be copying off of that particular creator.
There are many articles scattered throughout the Internet on this particular issue, and Im sory to pass this off on Google, without giving you a more SPECIFIC answer, but it's my best advice.
Books like the ARTISTS MARKET, and The Graphic Artists Guild Handbook: Pricing and Ethical Guidelines are both excellent resource that covers pricing and business practices and the issue of Copyright law as pertains to the visual arts.  Just get yourseld to the  Barnes and Noble or Borders, pick up a copy and start reading.  Good luck in finding an answer. Sorry I could not be more helpful.
