Question Friday evening I went to a local bar in Michigan. While in the bar I witnessed a female drink several drinks (she was in the bar before my arrival at 11:30pm) and after last call attempt to walk around the bar. The female was approximately 5 feet from me when she fell over and took a bar stool with her, which ended up hitting her in the head. The female staggered out of the bar with bar employees following her offering a ride or to call a cab. The woman walked to her car and proceeded to back out of her parking spot. There were 6 people in my party all walking to my car when the lady backed into my car and drove off. I wrote down her license plate number and immediately filed a police report and spoke with the employees of the bar who wanted little to do with the incident.
My question, is the bar responsible for the damages to my car since it was parked in their parking lot and the bartender allowed the woman to get that drunk and then the employees allowed her to leave drunk and drive?
I have damage to the drivers back end of my new 2005 car and I do not feel I should have to have my insurance pay for the damages. They are aware of the accident, I called and made a claim in the event the woman does not respond to the police request to come forward and turn herself in.
How liable is the bar and how should I approach this womans insurance company when I request payment for damages to my car from their customer? I have the police report which has the womans name first and last along with her home address but no telephone number to contact her for insurance information.
