Drunk Driving - Impairment limits for benzo-diazepam

Expert: Terence A. Russell - 7/2/2004

Question
What is the legal limit for impairment when benzo-diazepam is present in the bloodstream?

Answer
Hi Mary,

I am unaware of there being any legal amounts established for such substance. Of my experience, the only substance for which impairment limits have been established is for alcohol. Impairment due to the introduction of other substances are usually established by expert evidence, i.e. some person who observed your actions formed the opinion that you lacked either the normal use of your physical faculties, mental faculties or both. The issues involved in an arrest for DWI for some substance other than alcohol are usually such that it is wise to consult the assistance of a good DWI defense attorney. You can likely locate a good one by asking the court clerks where you case is set who they would hire if they wanted to fight a DWI case. They usually know who is most successful.

Good luck
