E-Commerce, Web Businesses - Loan Modification

Expert: Lee Horner - 1/18/2009

Question
I know you're a good and trusted lawyer.  We're in bad shape financially, facing foreclosure on 2 houses.  What Loan Modification Company can we trust, a company that creates good results.  I heard only Lawyers are allowed to collect advance fees, why do Mod Consultants do?

Also have credit card debts due to bad business ventures, is it true good negotiators could cut it down up to 50%?  Where do I go??????  I'm PUZZLED, LOST.

Is Bancruptcy the best route???   Are you still practicing Law in Arizona / California? Are you still praticing Law???

Answer
Hi--I am still an active Atty in CA and AZ however we've been out of the bankruptcy business since they changed the law a few yrs ago.  However, you should consult with a  bky lawyer so as to find out if a Chapter 13 would be appropriate--in some cases loans can be modified in a 13.  Before paying anyone to renegotiate for you, I'd get a free bankruptcy lawyer visit.  You will have to have surplus income available to pay into the plan over and above your regular payments or the plan won't fly.  Get some free legal advice first from a Chapter 13 atty & see what works out.

Good luck!
