Answer Hi--I am still an active Atty in CA and AZ however we've been out of the bankruptcy business since they changed the law a few yrs ago. However, you should consult with a bky lawyer so as to find out if a Chapter 13 would be appropriate--in some cases loans can be modified in a 13. Before paying anyone to renegotiate for you, I'd get a free bankruptcy lawyer visit. You will have to have surplus income available to pay into the plan over and above your regular payments or the plan won't fly. Get some free legal advice first from a Chapter 13 atty & see what works out.
