Employment Law - No Bathrooms Available

Expert: Thomas R. Ballas - 10/28/2009

Question
Hello.

I don't know if you are the right person to ask but here goes...

The bathrooms of the bldg I work inare being slightly renovated and it seems that the restrooms on all three floors are unavailable.  Isn't there a law against this?

I don't know if it matters but it is a campus-like entironment and there are other bldgs employees can go to but it means actually going to a different bldg.

Can you shed some light?

I have found a federal regulation that deals with this topic.
29 CFR 1910.141(c)(1)(i) states:

"Except as otherwise indicated in this paragraph (c)(1)(i), toilet
facilities, in toilet rooms separate for each sex, shall be provided
in all places of employment in accordance with table J-1 of this
section.  The number of facilities to be provided for each sex shall
be based on the number of employees of that sex for whom the
facilities are furnished.  Where toilet rooms will be occupied by no
more than one person at a time, can be locked from the inside, and
contain at least one water closet, separate toilet rooms for each sex
need not be provided.  Where such single-occupancy rooms have more
than one toilet facility, only one such facility in each toilet room
shall be counted for the purpose of table J-1.

That stated, I am sure there are exceptions for constructing and remodeling of existing facilities.  If the remodeling is soon to be over, I would not make a big deal out of it.
