Employment Law - Severance pay vs. wages paid instead of advance notice of layoff
Expert: Shirley McAllister, CPP, PHR - 10/27/2009
Question I was laid off from my job of nearly 10 years due to the economy. I was given a 4 week severance package. When applying for unemployment benefits in the state of Texas I am asked if I received "wages paid instead of advance notice of layoff." I am under the impression that the severance package was offered due to my long tenure with the firm. What is "wages paid instead of advance notice of layoff" and would a severance package necessarily be the same thing? Thanks.
Answer They are asking if you received a in lieu of notice payment. If you do not give the employee any notice and just lay them off typically you pay them a two week in lieu of notice payment.
However you will need to declare the severance on your unemployment forms as amounts received.
