Employment Law - black clothing requirement
Expert: Thomas R. Ballas - 10/27/2009
Question I've worked part-time for a nationwide department store for 5 years. They are now requiring us to dress 100% in black. I would need to work at least 2 weeks to cover the cost of 3 shirts, 1 pair of trousers and 1 pair of shoes, since black is not a color I wear. The only assistance the company is offering is 15% off black clothing bought in the store - but I'm too small for any clothing sold in-store.
The prior dress code was standard retail business casual.
Is this a reasonable requirement, especially as it wasn't a requirement when I accepted the employment offer. If it is reasonable, would some compensation be expected?
Answer Andy:
Some states have laws on this issue, but most do not. It seems reasonable to me for the company to assist in purchasing such clothing, but absent a state law on the issue no requirement by the federal laws.
Go to your state's web site and look under employment to see if such a law exists in your state, or let me know where you live and I will research.
