Employment Law - boss not paying me hours.

Expert: Shirley McAllister, CPP, PHR - 10/28/2009

Question
Hi I have been working for my boss for a year. my regular hours are 10 am- 4 pm. sometimes my boss makes me come in early or leave late, so I put my hours on my time sheet and at the end of the week, she changes them to 10-4 even if she had me stay an hour late or something. now I found my copies of my time sheets and for the past 7 monthes she's been whiting out some of my hours whithout me knowing. I'm pretty sure this is illegal and what should i do?

Answer
You should report it to your local department of labor. This is illegal and it is falsifying a legal document. Timesheets are legal documents and are not to be changed without the approval of the employee and then if the change is made they should be initialed by the employee.

She is doing this to keep from paying overtime pay. This is highly illegal and you should take your copy of the correct timesheets to the department of labor and they will see that you are paid the time you worked and did not get paid. If it would have been overtime than you will be paid it at overtime wages.
