Employment Law - FMLA Required Time Off

Expert: Thomas R. Ballas - 11/4/2009

Question
I am taking 4 weeks off of work in December to have a child.  I have enough accrued paid vacation time to cover my time off of work.  Am I required to use my FMLA time also?

Answer
Andrea:

If you request vacation and do not mention the birth, your company should not put you on FMLA. If they know you are taking off account the birth, and WANT you to burn your FMLA they could designate the time off as family leave.   Most companies will not do this.
