Question
According to my company's policies, we need to serve a notice period of 1 month or pay for it by a month's salary. I have certain personal constraints due to which I would not be able to serve the notice period when I resign. I would prefer to pay by a months salary. Can a company still insist you to serve the notice period? If not served, can it hold back my Relieving and Experience letter?

Dear Madhu,

Hope you're doing fine.
Any employee who is terminated is given a notice of 30 days so this employee finds a good job or pays a salary of 30 days (if terminated without notice) and in the similar way whenever an employee resigns he/she submits 30 days notice so the company may find replacement or loose a month's pay. That's the rule. Removal of notice period condition depends on your relations with the company too, they might withdraw your notice period if they wish. But yes they may hold you releving and experience certificates if proper notice or notice pay is not submitted. Speak to your supervisor he/she may help you out in getting relieved early if you think you have good relations with them.
