Question
I work in RI but my company is based out of MD.  I am a salary employee and get paid bi-weekly. I have direct deposit.  I did not get paid on my scheduled payday.  Is this illegal?  If this is illegal, what can I do about this?  My employer did not give notice to this late payment and now i have over draft fees in my bank account.

Rissa:

If the employer missed the regular payday, then he did not pay you for the time worked.  Given this, he is guilty of violating federal minimum wage laws.

You can go to your states web site and look under employment regarding how to file a wage claim.
