Employment Law - MANAGEMENT HOURS

Expert: Thomas R. Ballas - 7/8/2009

Question
I just read the answer from Marie in Montana concerning hours worked in a week for a salaried manager, and mine isabout the same issue, I signed a contract offer sheet to a straight salary based on 50-55 hours a week, am i entititled to any comp time if they schedule hours on my off days that take me to 60hrs in a work week. thanks for your help.

Answer
Lee:

As an exempt employee, meaning exempt from overtime laws, you may be required to work in excess of 40 hours per week, without overtime pay.

I do not see where Montana law requires comp time if you work excess the 40 hours.

You say you signed a contract offer sheet that stated 50-55 hours, and you are working 60 plus hours.  You may be morally entitled, but I do not believe legally entitled to off time or more pay.

I would meet with my Supervisor, show him the offer sheet, and request he decrease my hours accordingly.

Of course, you must be prepared for his reaction, which may be adverse to your continued employment.
