Employment Law - NY Law governing paid / unpaid internships

Expert: Shirley McAllister, CPP, PHR - 7/1/2009

Question
Where can I find a downloadable copy of the NY law governing paid/unpaid interns? Also, Both the Federal and CA laws regarding interns allow six criteria to be met that allows for an unpaid intern... is this also the case in NY or are the only options to pay the intern or the intern must receive college credit? I wish to have an unpaid intern not gaining credit... but meeting all 6 of the criteria listed by the Federal Law. Thanks

Answer
I think that the links below will help you out. There is not a specific law on the books that govern's internships, however, it is common in New York to provide unpaid internships. From what I have read they must be a learning experience and the student must gain as much of a benefit from the experience as the company does from the work the student accomplishes.

Shirley

John,

If you find it I would be interested to know. I spent a bit of time searching in my employment law books and on the internet everywhere I could think of NY DOL, State of NY, I could not find one specific to NY. There is a federal law, but you already know that. It would be nice to know for someone else that might ask.

Thanks
Shirley
