Employment Law - breaks at restaurant

Expert: Umesh Chaudhary - 7/8/2009

Question
I used to work at a restaurant in which we were scheduled at 515pm. We would start our shift with a 10 minute pre-shift meeting then once the meeting is over. we clock out and go on our 30 minute break. We then would go back to our shift at 6pm and work for the remaining ours straight without a break. i would work from 6pm to 11pm and sometimes ever 12am to 1am. I was just wondering, is this process legal?

this restaurant is located in Anaheim, California in the USA. I work as a waitress.

Answer
Dear Diana,

Hope you're doing fine.
No doubt you're a hourly paid employee. As far as your employer pays you full payment for every hour worked it's legal. What's your major concern about?

Take care,
Best regards,
