Employment Law - tardiness

Expert: Jason Barnette - 8/19/2009

Question
At our company we have about 35 employees. We use a timeclock for punching in & out. Every Wednesday our time is printed & if you are late there is an asteric by your time. I am verbally told at work on various occasions that I am needed to come in earlier. (7:15, 7:30, 7:25) in the system I am supposed to be here by 8:00 before an asteric is by my time for tardiness. Can my employer write me up for coming in at 7:32 even though I am in the system to be here at 8? This is only happening to 4 people in the company. I have been with them for 11 years & never been written up.

Answer
Tina:

No, your employer should not do this.  Insofar as you are a female, you are a member of a protected class.  If you feel this practice is discriminatory you should consult with an employment attorney.
