Question I'm getting married in September. My 2 year old son and myself currently live in Florida. We will be relocating to Arizona. My fiance is in the Air Force. I need to be able to show proof of sole custody. When I found out I was pregnant, the biological father took off. I did not know him long. I'm not even sure I have his real name. He has a criminal background. I am the only parent listed on the birth certificate. He has my last name. I have never tried to get child support. (I don't want it.) I have idea how to find him. Is there a way I can get paperwork that says I am the only parent? I can't exactly afford to get a lawyer right now. My fiance would eventually like to adopt my son, but we are waiting a year after we've been married before we take that step. Thank you!
Answer Hi Sue, the only way to get an order granting you sole custody is to file a Petition for Paternity and within the Petition request sole custody and parental responsibility for the child based upon the fathers abandonment.
