Subject: my niece

Question
My brother was married for about 8 years, they divorced and have a child. He didn't stay faithful. My sister in law chose to move in with her mom and let their daughter stay with him where she was better off due to the area. My brother then moved in the girl he had an affair with. He has residential custody of their daughter, he refused any support from his ex wife. Well he is now keeping my niece from her mom along with everyone in her family and our family. What is residential custody? Do we have rights and what can we do to help her see her daughter, it has been over a year. She finally got a lawyer but it is taking sometime.

Answer
Dear Tracy

In many states family has  visitation rights as well as the parents. You may want to consult an attorney as well. If she has an attorney, you might want to leave well enough alone and stay out of it. If you take sides that may cause more problems.
