Family Law (Divorce, Family Relations) - Breach of divorce decree

Expert: Jeff Laatsch - 10/26/2009

Question
I am wondering what course of action I can take for an ex-wife that is not following the debt agreement that we signed for our non-contested divorce.  We divorced in Mar09, and I was sent on deployment a short time later.  In the decree, she was to start making payments on a car loan.  Both of our names are on the contract and she has not been able to find work to refinance and get me off of the loan.  So with that being said I have been making the payments in an attempt to get my credit back on track.  She has said that se will start paying me back, but 7 months and $3000 I have not seen any action from her to make the payments up.  I am wondering if I only can take her to small claims, or file for a contempt of court.  Or worst case scenario, am I going to have to suck it up and just hope that she starts to pay me?

Answer
Matt:
DISCLAIMER:
I AM NOT A LAWYER or ATTORNEY. I am someone who has experience with family law issues, and am sharing my OPINION only. For the exact law as it pertains to your specific case contact a Professional Attorney in your area/county/country.

I recommend hiring a Professional Attorney: Most Attorneys offer 1/2 free consultation time to discuss case and payment options.
- Be prepared for WORST case: If ex files for bankruptcy, and you are co-signer you will be stuck with bill.
- AND it will effect your credit history.

Kind Regards,
Jeff
