Family Law (Divorce, Family Relations) - Divorce: Spousal Support/APL

Expert: Jeff Laatsch - 10/23/2009

Question
My attorney is out of the office and I've haven't been able to reach her.  We settled our divorce and all support for her about 4 years ago.  She relocated from VA to CA and the kids stayed with me in PA for 5 months; they are now back with her.  Rather than just filing for support of the kids, she's also filed for Spousal Support, APL, mortgage support and health coverage.  I can't believe that the system would allow her to open a new claim and have me support her again after this was settled in 2005.  Any thoughts?

I AM NOT A LAWYER or ATTORNEY. I am someone who has experience with family law issues, and am sharing my OPINION only. For the exact law as it pertains to your specific case contact a Professional Attorney in your area/county/country.

Yes, you are correct: I recommend that you need to hire a Professional Attorney ASAP: Most attorneys offer 1/2 free consultation time to discuss case and payment options.

MOST spousal support is a 'Temporary' case not going more then a couple of years: It all depends on income: If the person makes 'Millions' of dollars even then one settlement figure is made, not continuing spousal support.

APL???, Mortgage support and health care coverage should all be covered for the kids under child support: AND you should not be responsible for her end of the deal.  The ex has had four years to get a job.

Work with Attorney immediately to get this straightened out AND DO NOT DELAY because if you do the ex may succeed!

Kind Regards,
Jeff
