Family Law (Divorce, Family Relations) - Moving to NY form Florida

Expert: James Robinson - 10/1/2009

Question
My niece asked me to draft an agreement already discussed by her and her ex-husband in regards to her relocating to NY with thier son. The details of the move have been agreed upon and he is apparently ready to sign.  I want to know aside form the agreement being clear, what exactly needs to be agreed upon and where shall this be filed.   Thank you in advance.

Answer
Dear Nick

You don't have to file it. All it has to state is that the father consents to the move. If the parties want to change visitation or support that is in a court order, then the new agreement should be incorporated into a court order approving the agreement. That would have to be filed with the court that issued the original order.
