Family Law (Divorce, Family Relations)/child support
Expert: Dan Bachert - 10/28/2009
QuestionI moved from Orlando to Phoenix about a year and a half ago. Recently I was sent a letter that my ex has opened a case for child support against me. I am not trying to get out of paying but I have a few issues. First I would like scientific testing done, second I would like to be able to appear in court in Arizona and not over the telephone. Our constitution and general tort law states very clearly that any defendant civil or criminal has the right to face his accusers, general tort states that a civil suit shall be brought into court where the defendant resides. Are they going to claim long arm jurisdiction since the kids live and were born in Florida? How do I get the fair trail I deserve if they do so that I can appear in court in Arizona?
Thank You
AnswerHi Christopher, jurisdiction for child support cases is established where there children have resided for a period exceeding 6 months.
