Question My husband and I lost in the battle for shared custody with his three children.(we were dating at the time) As it stands now, he is an everyother weekend father(its killing him emotionally)and their mother has remarried.Mother now gets 50% of his gross,(can go up to 55% in Kansas)tax free and he pays income tax. Now the kids are doing without the things. They need school supplies and she expects us to pay, clothes,...She plays the victim and tells the children we don't pay her enough.We take these issues one at a time and choose our battles carefully.The real big issue is the divorce papers say she is responsible for 1/2 what insurance does not cover.(we provide insurance)QUESTION: We pay our 1/2 and she doesn't. Can the doctor/dentist go after us for collections for the remaining balance or are we bound because we are the one providing the medical insurance?How can we deal with this without her stressing the kids harder.fyi children ages are 11,14,17 and normal health.
Answer Hi Theresa, if the mother is not following the order then the only action to take is to file a Motion for Contempt so that the court can compel her to follow it. The doctor/dentist can definitely move your account into collections for any outstanding payments and those payments will be sought from your Husband not the mother.
