i am the step mother of a 2 years old. my husband has sole physical custody and joint legal custody with the biological mother. we now live in Oklahoma but most of our family is in California including the mother.i plan to visit our families with my 2 girls but without my husband for work reasons. do i have the same rights as my husband when it comes to our 2 years old and can the mother legal try and take our 2 years old from me while were in California since my husband wont be with us? also if there is someway i can adopt her?
Answer Dear Miriam
Technically, you do not have the same rights as your husband. If the custody order gives the mother the rights of first refusal, then the mother has the right to have the children. If you are only going for a few days there shouldn't be a problem with the mother. You could adopt her if the mother terminates her parental rights. Good luck
