Family Law (Divorce, Family Relations) - What can I do

Expert: Dan Bachert - 10/23/2009

Question
The father of my daughter went to Japan before she is born to avoid paying child support.  What can I do.  In Japan man do not pay child support becase it can not be enforced in Japan.   Can I have his US passport taken away for not paying child support.  He also has a Japanees passport.

Answer
You should file an action for Paternity and Related Relief, where you reside, have the Father served with the Petition, prosecute the Petition and then after an Order establishing paternity is entered together with an Order for Child Support and the order is not complied with file a Motion for Contempt and request within that motion that the Father's passport be suspended until such time as child support is paid in full.
