Question Hi, I've been divorce since 2003 and have a 15 year old daughter. Over the course of her life I have been the parent who has done pretty much everything regarding her.....getting her into good school, girl scouts, cheerleading, other social actiivites, etc. I remarried in 12/08. My daughter gets along well with her step-father but does not want to move out of state. It about a hour and 1/2 from where we currently live. She stated she will miss her friends and her school. She would prefer to live with her dad. her dad has been very nasty over the years (well since I started dating) and says ugly things about me in front of our daughter. He lives on the edge and takes no responsiblity in life...FUN parent. I know our daughter will be better off living with me in a stable enivornment. She at the age where she will start dating and I also want her to see a healthy relationship. Her father has contested the relocation....Will my daughter have to testify......I do not want her in the middle weather i win or lose....I do not want her to regret decisions you feel cause the final result.....HELP
Answer Hi MDR, the relocation statute requires the court to consider the testimony of the child subject to the relocation if the child is otherwise competent to testify.
