Family Law (Divorce, Family Relations) - Visitation and Custody of children

Expert: Ch. Ejaz Ashraf - 6/18/2009

Question
I am from SA and urgently need your advise pertaining to the a matter at hand. I have been divorced since September 2006 by Islamic Law. Visitation rights was granted to my ex. Unfortunately he had broken every written Islamic agreement pertaining to the visitation rights. Matter was reffered to an Attorney, which he refused to respond and comply with. In 2 years and two months he has neither contacted the Attorney and neither supported his two kids in any way. I have now received a letter from his Attorney stating that he would like to have visitation rights applying the Islamic contract which was signed by him, which he broke.

Please advise on the Islamic and Secular Law.

Kind Regards
