Family Law (Divorce, Family Relations) - relocation

Expert: Dan Bachert - 6/24/2009

Question
I filed an intent to relocate and my ex-husband objected (even though we verbally agreed the child would relocate). I also filed a motion for a temporary relocation order which was heard last Thursday by the magistrate. I did not receive an answer from the hearing and was told an order will be issued after some additional research and there is no deadline for this order. Meanwhile, my husband has already relocated to Denver and we are moving on Monday to our new home in Denver. My son will be going with us as I have three weeks in the summer in which his father does not have visitation, however I would like to know whether I have to return my son to Florida if I have not received an order by the end of the three weeks. School will be starting shortly after that time and I also need to get him schedule with a new orthodontist. Please help.

Answer
Hi Michele, if there is no order permitting the relocation after your three weeks of uninterrupted summer time sharing then yes, to be in compliance with the standing order for time sharing, your son would need to be back in Florida in time for the Father's next schewduled time sharing period with the child.

I hope this information was helpful to you.
This answer is based solely on the information you have provided in your question and as always, I would advise that you arrange for an in person consultation with an attorney from my firm or another Family Law attorney familiar with Florida Family Law who can analyze the specific facts and circumstances of the case more closely to better advise you.

Sincerely,
