QUESTION: My Husband's ex wife has gone to court system again....
We live in Wilcox Co, Alabama.
He pays to send his daughter to a private school because our public school system is not that great. His ex wife is now wanting to remove her from private school to enroll her in public school system just to get the compensation he pays toward school in child support. She wants to enroll her in another co from where she lives. what do we do?

ANSWER: Dear Aleshia

The misunderstanding the mother has is that she would get the equivalent of the tuition. She would not. You can ask for custody based on the changed circumstances of the school issue.

QUESTION: so are you saying since her cirmstances has changed since the last court we could ask the court for custody. how do you go about all of the legal aspects.... wouldn't you have to show the mother unfit or something?

Answer
No, you have to show it is in the best interest of the child for husband to have custody. It is unusual that a mother would be so blatantly prostituting herself but if you show the court that you would send the child to a better school that might be enough.
