Question I was with my husband for 34 years and he wanted a divorce. I did not contest his divorce and did not get my own attorney. Instead of going after all his assetts - I agreed to 20% of all his gross income until he fully retired. We were divorced in August of 2007. Knowing what his salary was at that time I did recieve 20% of his salary during 2007, unknown was what other income he recieved during that time period which I did not recieve. i.e. rent income from his holdings, interest income, consulting income. During 2008 he was laid off from his fulltime position, however, he still does consulting work. I have even received emails from him telling me how much he made for flying to Italy for a seminar he held. I have not recieved any alimony as of January 2009. How do I go about getting my alimony that is due me for 2009 as well as what was previously owed. I am now living off my credit cards, as his divorce agreement states that all alimony stops if I work or get married. I asked my accountant about his income, (yes, we still use the same accoutant) and he would not tell me. With the exception of saying,"It's my right."
How do I go about getting the information on his income along with enforcing him to pay me? When I asked him when he was going to send me funds, he said "Sue me". Looking back I made a very stupid mistake by not getting my own attorney, however, I did not want to be one of those spiteful ex-wifes and instead I am almost bankrupt. Please advise. Regards
Answer Hi Kandy, you need to file a Motion for Contempt and Enforcement and during the pendency of the case you can obtain records regarding your former Husband's income through the discovery process. You may also be entitled to attorney's fees and costs incurred in bringing the Motion.
