Family Law (Divorce, Family Relations) - Divorce Florida

Expert: James Robinson - 4/4/2006

Question
Good day, Sir I am in the military stationed overseas and am filing for a divorce in the state of Florida. I have done some research attempting to obtain information related to my pay and child support. I recieve a few different pays some are taxable by the federal government some are not and Florida doesnt have state taxes. My informaton is are all my special pays taxable in relation to child support. For instance I recieve pay for food, housing, regular pay. Only the regular pay and food pay is taxable. Do you know what the state will consider in relation to child support. We have three beautiful children and I am not attempting to run from my responsabilitys but the amount calculated would not leave me sificiant pay to cover my monthly expensises living in Europe. Any help would be greatly appreciated.

Answer
Hello

I am not licensed to practice law and cannot give you legal advice, which is essentially what you are asking for. I know that most states have a chart which determines the amount of support a parent pays based upon gross income. What is included in gross income is different from state to state. All states also have exceptions for special needs, etc. I cannot answer any questions about the Florida system for determining child support. I recommend that you ask the company JAG officer what you need to do.

If I can help in any other way, I would be glad to assist you.

Good luck
