Question OK WELL I HOPE THAT YOU HAVE A MINUTE TO ANSWER THIS QUESTION... I STARTED A BUILDING PROJECT IN 2006 WITH A CONTRACTOR THAT ACTED AS MY GENERAL CONTRACTOR HE THAN HIRED ALL THE SUB SONTRACTORS THAT SPECIALIZED IN EACH BACK GROUND THAT THE PROJECT NEEDED, OK THAT WAS GOOD BUT HERE GOES THE ISSUE. HE TOOK A CHECK FOR 51415.00 AS HIS FIRST DRAW FROM THE BANK ON 8-06-06 THAN BEFORE PRESENTING A SINGLE LIEN WAIVER ON 8-16-06 HE TOOK AN ADDITIONAL 18485.00 FOR A TOTAL OF 69900.00 WHICH WAS OK TO A POINT THE CONTRACT THAT WE HAD TOGETHER HAS A 69900.00 AS A FIRST DRAW AMOUNT THAT WAS AGREED ON AT THE TIME OF THE CONTRACT. WELL SHOULD THE BANK OF DISBURSED THE FUNDS ACCORDING TO THE SWORN STATEMENT TO EACH INDIVIDUAL SUB NOT THE GENERAL DIRECTLY???
Answer Hi,
The answer is yes, the General Contractor is responsible for the completion of the job, no his Sub-Contractor's. It is up to the General Contractor to pay anyone he hire's to do the work, since in essences, he is the Boss.
