Question dec 8 2004 we closed a sale legally selling our home in CT.
Our attorney sent the chase Mortgage co, $242,000. the next day by fedex to satisfy our mortgage. when we applied for a home equity loan in Jan 05 with chase we were told they have not gotten the $242k from Fedex... Fedex advised us they did not deliver the check ,,,they lost it... our lawyer has issued a new check to chase for 242K,, but chase wants another $8000.
for mortgage payments they say were due Dec Jan and Feb plus penalties....even though we do not own the house anymore...Chase has documentation of the fedex problem but they do not care!!! they want the 8K or they say they will forclose on us..... we have had perfect credit for the past 30 years and banked with chase for many years, What is our recourse? thank you !!
Answer There is only one way when confronted by a huge corporation that will not respond to reason: Get a lawyer, plunk down $500 to retain him, and send off a Cease and Desist letter. Their legal department will have to respond, and they will suddenly begin taking you seriously (probably for the first time).
Sadly, until you have a lawyer's letterhead behind your communications with these people, they just dont care, as you said. If you don't pay they'll send it off to collections and proceed to ruin you. But once a lawyer is involved, they suddenly become careful, realizing that one false move and they could be out a lot of money.
So run, dont' walk, to a good consumer affairs attorney. The Yellow Pages is full of them. Explain your situation and say that you don't need them -- yet for any court stuff, but just want then to provide counsel and a letter or two to help get a little justice. Most will be happy to help, and it won't cost you much.
