Question i am considering bottling my own bbq sauce, but until now i have been using specialty ingredients from the supermarket shelves to create my recipe. if i start mass producing this sauce, will i be able to use these name brand igredients without permission
Answer William,
Good Morning.
First and foremost is my disclaimer on anything within the legal realm. In other words, get a local attorney to give you the definitve answer to your question.
That being said, what you can't do without permission is put something on your label that says " made with Johnson's peppers" or something like that, without permission from Johnson. However, that doesn't stop you from using them, you just can't use their name.
Essentially, once their peppers are blended into your product, they lose their identity and become part of a larger whole ( the sauce ), which now has its own identity.
BTW, if you are considering mass producing, you will likely start out utilizing a contract packer, and most of them are pretty adept at these things since they do it every day for their various clients.
