Question
I live in Swansea MA.  I wanted to start to start a small business and apply to be a residential kitchen.  I have been researching online and also went to visit the Board of Health in my town. I was advised with a residential kitchen  I can only sell within the state of MA and only directly to the consumer.  How can I also sell my (cookies, biscuits, cake) products via a website online?  Do I have to apply to be a residential kitchen wholesaler? The regs/rules seem confusing between the Board of Health and the FDA.  Can you please give me any advise or explain to me how people sell via the internet?

Answer
Regulations vary widely from State to State.  For example, in my State as well as most of our neighboring states, residential kitchens are not permitted for any use, whether in-state or not.  

The products you make will determine what you can do through a website.  It sounds like you would only be approved to sell retail with your residential kitchen.  Massachusetts has a very good website with resources for wholesale operators.  Not being located within the State, I would refer you to the website for a better source of info:
