Question My home has been sold at an non-judicial auction, I am wondering what are the laws for me, he has gave me a piece of paper saying he is the new owner i had 7 days to leave and he does not need to go to the courts to remove me. As he is the new owner does he and I fall under the landlord tenant act he says we do not fall under that and that a forcloser is different. I have asked a few attorney's a couple says we fall under it and a couple says no so I am at a lost. I don't want to stay here and fight just needing time to move and I am scared going to come home and locks are change. Anchorage Alaska
Answer I am not a native of your state so I am not familiar with your statutes to this detailed a degree. But if your process for non-judicial auctions is like ours it is performed by the sheriff department civil division or someone similar. If so, I would be contacting them to see what the eviction process is in a foreclosure situation.
I am not saying he is wrong but this seems very fast. I know I can't just evict someone in 7 days. And yes, it does take a court order. At least around here.
First thing you need to do is find out the law on this. Try the sheriff department first then seek legal advice. Many areas have free or low cost legal aid to help with the foreclosure crisis so there should be plenty of experts in your area.
Best wishes.
