Foreclosure - foreclosure, fraud, forgery

Expert: Dennis Herman - 3/15/2009

Question
A complaint for foreclosure was began on 6-27-2009 and on 1/14/2009, substitute trustees filed Motion to dismiss.  Prior to this action, a sale to Deutsche took place in the amount for $67,200 using a forged and fraudulent notarized FINANCE AFFIVIDAT (LAND & RECORDS document) to record the home as a purchase when it was refinanced.  I personally know this notary and am so hurt by her actions.  THe other paperwork that was presented at closing are authenticated by the notary that did the closing, however, their are discrepancies in the outstanding loans, they add up to 292,000 when it was recorded for 268,000 (first) and the second that was never recorded only fraudulently in order to foreclose have the amount of 67,200 when if you add both figures they add up to almost 360,000 when the loan was only 335,000 total.  the fraudulent one was used to foreclose (jr lien).  All have lost note affidavits signed by Deutsche when the lender was claimed to be WMC Mortgage, but the monies were at all times paid to Chase.  Deutsche was never mentioned in any documentation.  I was never notified that the loan had been purchased or going to be serviced by Chase.   The paperwork is so confoluted I can't make heads or tails of it.  THe home was purchased in 2001 for 164,000 and the Deed is currently still in my name to this day.  The paper work says Deutsche is the owner.  I feel like the house has been basically stolen.   Please give me some incite into this situation. My home has been completely gutted out.   What can I do? besided getting a lawyer.  I have contacted the state's attorney, the FBI, Office of the Comptroller, etc.   What do you advise.

Answer
I have a license to market real estate in the state of Wisconsin.  There is another Expert that is a licensed attorney in CA.  Let me look up a link and send it to you.  I will give this some thought and see if I may have a suggestion.  I have never heard of anything of this type happening.  Thank you for sharing.

Here is a link to a list of attorneys on this web site more qualified to answer your question.  I have no idea how to handle your situation.  I hope one of these can help you.
