Question
We got a our Notice of Default dated December 3, 2008.  The DOT has the mortgage broker recording date 3-28-06.  MERS, Wells Fargo and the Trustee Service was not recorded on the Deed until December 29, 2008.  My understanding from what I read is that you have to be on the Deed of Trust to start foreclosure proceedings.  So at the time they started foreclosure they were not on the Deed.  We are in a non-judicial state.  Please explain if you can.  Have I misunderstood what I have read?

Sorry I can not explain this one.  I am licensed to market properties in the state of Wisconsin and not dispense legal advise.  

With the way banks are merging and changing names you may have been caught up in a change of this type.  Lenders also buy and sell loans.  Because loans are sold as a package, the buyer my not know what status they are in until the details have been delivered.  

I do not think you will be able to find a legal loop hole but you may be able to buy some time.  I would talk to an attorney to see if they can do anything with this situation.
