Question The mortgage on my home was contracted in my husbands name only one month before we married fifteen years ago. I live in Florida. He submitted a written request that I be allowed to assume the mortgage six years ago before we split up, but the paperwork was never received. He signed a quit claim deed on the day our divorce was finalized. I paid the mortgage faithfully until a few months ago when I lost my job. I have a new job now and am back on my feet, but the mortgage company will no longer accept payments. I'm facing foreclosure. The mortgage company has sent offers to my address for a loan modification, but to my ex husband only. I don't know where he is. They talk to me because he authorized it years back, but they refuse to allow me to make transactions. Do I have any rights here or am I stuck with a foreclosure?
Answer I am dealing with a number of lenders on a daily basis. I find they like to do business their way or no way at all. I feel they have lost touch with the concept of being a service industry.
If you feel you are being treated unfairly, collect all the evidence you can, papers, dates, phone calls, contact names and numbers and file a complaint with your local state bank commissioner. In Wisconsin this will show up with ease on a Google Search using the key words WISCONSIN BANK COMMISSIONER. The contact information is found on the web page for Wisconsin Department of Financial Institutions under the section Division of Banking. You should have no trouble finding the contact information in your own state.
I can't understand why a bank would treat you in such a way.
