Foreclosure - Owner Financed Forecloseure

Expert: Dennis Herman - 9/10/2009

Question
I owner financed a 15 acre parcel of land with a home to a man two years ago, as of 2 months ago he stopped paying and is now moved out. He has disconnected all of his phones and I cannot get int ouch with him. How would I foreclose the land, he has not paid but 10,000$ of 120,000$

Thank you.

Answer
This is a good question.  I have never been involved with an actual Seller Financed sale, although I have discussed the possibility with a number of sellers.  The problem is, the buyer never has the required down payment to cover the costs involved.

If I were you I would contact a local attorney to do the paper work, insuring everything is completed according to state laws.  You will also need to make sure the taxes are paid so the matter does not snow ball and bury you in a mountain of problems which may arise.
