Question Hi,
We are looking for ways of raising funds in our charity in the UK (Air Cadets). One of our members has written a programme that allows scratch cards to be sent electronically to a mobile phone / cellphone. Would we need a gaming licence if the scratch card is free, but we charge a premium mobile connection fee for the download (say £1.50 to download the card with a possibility of winning £1000)?

Answer Thanks for the question. Please do not shot the messenger, but any form of payment with the possibility of winning a cash prize is gambling and in Nevada you would need a license. Since the USA does not like online gaming, I sincerely doubt they would be remotely inclined to be willing for a charity or not to issue a license. This might be allowed in other countries, I am not familiar with worldwide gambling laws, but you might have something that works in countries other than the USA. Another problem you would have in the USA would be phone lines have no boundaries and they do not make a federal gambling license, so I have no idea how you would regulate this per state.
