Question QUESTION: Seven friends get together once a month to play Megabucks. There is an unwritten agreement that they will split the winnings. Each puts $100 into the kitty and they take turns playing until its gone or there is a sizable win. If the Megabucks jackpot hit when one of them was playing and he decided not to split with the others, do they have any recourse?
ANSWER: As the old joke goes, verbal contracts are not worth the paper they are written on. Seriously, in Nevada gambling debts and pre arranged deals can be upheld in court. Recently a pre arranged deal on how to split the money won at the World Series Poker Tournament was awarded to the person who did not get paid, and that was not a signed contract deal. HOWEVER, the cost of lawyers to prove you are right might be more than your share could be. This might take years to go through the legal system and of course there is never any guarantee you will win the case. My suggestion is to get everyone to sign and eliminate any future problems.
QUESTION: What is an unincorporated association and would such an agreement hold up in the above scenario?
Answer That may be a question for a lawyer, but I think you could just reduce your risk significantly if you just reduce your intentions to a written instrument. Basically, anything is better than what you have at this time.
