Question QUESTION: My EX girlfriend of 3 years who we were living together in clearwater FL recently broke up with me and told me she has been seeing someone else for the past two months and she asked me to move out.when i was hesitant to move immediately considering I paid the bills and mortguage i tried to stay until i was able to get another place on my own so then it began she went down to the court house to get a 15 day temp restraining order against me the court house people told her what to put down to have me removed she claims i hit her and that i am mentally handicapped and issued it on no real true grounds never been charged nor were the police ever called in 3 years.
Question is we have ct on thursday what is the burden of proof in fl?

My advice is to go to the hearing and say "of course this is a lie) but say to the judge you love still this women, never will and never have hit her. And that you still want to be with her, explane you respect her wishes and will sell agree to sell the house and split the profits. Forget the burden of proof. With no legal representation a thrid party (a judge will do what ever they want). You judge need to seem like a cory pitiful guy who is a loser, whos been taken advantage of by a women. I know of this working many times. It when you go in thier seeming like your the all powerful male dominate guy; the judge thinks; were not going to let this man control this womens life. Trust me. QUESTION: ok but what if the judge bases a new 1 year or 3 year restraining order against me my question is can the judge do that just based on what was said in the initial claim. you see she claimed I hit her I was diagnosed with bi polar disorder and that I threw furniture at her all untrue and no police reports or hospitalizations and no diagnosis she did this to get the locks changed then this week i have proof she tried to make contact with me by leaving messages and calling my other family members why or what is the proof of evidenance to prove her claims?
Answer Your question is. Can the judge base a 1 to 3 year restraining order against you based on what is said in the initial claim? Okay. A judge can and does what ever they want. Especially when they see you do not have a lawyer, but these Judges do not think all these females are telling the truth. I have seen a case were the judge said you have to be kidding. This guy has done nothing to you. Thanks for wasting the courts time; Case closed. Oh are you bi polar? Does she have legal counsel? If the answer is yes two these questions. You need legal guidance yourself. Her contacting you is good. But that is not evidence of a lack of abuse on your part. Go in their relaxed. Let her say what ever she wants.
