Question Hi James,
I, along with my mom and sister, are interested in designing and selling specialty t-shirts. One of the designs we created is in Michael Jackson's likeness. His name, as well as his title song, "Bad" is in the design. Would it be illegal to sell t-shirts with his likness on them; although, he is deceased? Thank you

Answer Lisa,
Yes, it would be illegal for you to sell any item with the likeness of any person living or dead without their permission (there are some exceptions such as politicians!). You could get what are called licensing rights from the Jackson family to use his image and you would have to pay them a percentage or fixed amount on each one you sold. You may be better off with designs that are not linked to celebrities as it will cost you quite a bit of money to buy the rights to use their likeness or name. Good luck!
