Question I am a US citizen residing in Dallas Texas but I am employed by a German company called Premium Rentals GmbH. Per my employment contract, I am to receive a base salary of $2500 per month, payable every 15th of the month. December was supposed to be my first actual payment, but now we are into the new year and I am still empty handed. Answer After trying the Munich fax number unsuccessfully I contacted the German directory enquiries. I am afriad, no such enterprise has been registered in the public phone book.
What would I suggest? - Should German law be applicable to your contract I would advise you to refuse to work due to the employer´s default to pay your wages.
If a law suit for payment is worth the effort depends on wether the company still exists and/ or if the company director can be held liable for the default. Tis would be the case if the company had been bancrupt or out of money already when your contract was concluded.
Maybe you should send an inquiry to the commercial registry in Munich (Handelsregister) at the Amtsgericht München in order to find out if the company has ever existed (Fax 0049/ 89/ 5597-3560) and to the insolvency court (Insolvenzgericht) at the Amtsgericht München in order to find out if the company has filed for bankruptcy recently (Fax 0049/ 89/ 5597-2777).
