Question
I am a from Brazil and I get married with a German citizen back in 2004. We get married in Denmark. We stay in Germany for a couple of years and later we moved to Brazil. After a year did we break up and he returned to Germany but I decided to stay in Brazil. On the paper are we still married but I have now lost the contact with my German husband and he have now change his address, phone nr. and contact details so I can not get in contact with him. Now I want to separate and divorce him because I want to continuo my life. When I contacting Denmark where we get married do they tell me to get a layer in Brazil and in Brazil when I get in contact with a layer do they tell me to find a layer in Denmark. This make me very confused and I don’t know what to do now. Or must this separation / divorce case take place in Germany since my husband is German?

Hello Edilane,

you can chose jurisdictions: Either Brazil or Germany.
Denmark has no jurisdiction.

As your last joint residence was in Brazil, the German court would also apply Brazilian divorce law.

The main problem will be to find your husband.
If we won't be able to do it, we might still go ahead and request the court to grant the divorce, but we would need to show that we did everything to locate him (like call his family, do searches in public records, etc.).
