Expert: Andreas Moser Date: 6/29/2008 Subject: alimony to unmarried partner ( mother of child)
Question Hello,
I got your email contact while browsing throug the internet.
I am an Indian national and i reside in the Netherlands because of work reasons.
I have a child with a lady who resides in Germany. The child was born on oct 2005. I had been paying child support ever since and the same was decided by the jugendarmt first and then also by the court.
I had also been asked by the court to the mother of my child and i am paying her alimony. I was never married with that lady and nor did we stay together.
I got married last year and we dont have a child yet.
My question is, after my child turns 3 years this year in november, will I still have to pay alimony to the mother of my child. If yes, what ways are avalibale for me not to pay, including if i leave Europe. In what ways can you help me?
Thanks in advance for your answer.
regards

Answer Hello David,
if the mother will be eligible for alimony after the 3rd birthday of your child depends on the following questions:
- Will she have a childcare facility available?
- Is the child old enough to enter this facility?
- How easy is it for the mother to find a job?
The court would consider all these factors.
Unfortunately, the courts often are very reluctant to cut off the mother from alimony right away and still award (partial) alimony for a few more years.
Once you leave Europe, the case in Germany will go on, but the mother will have to enforce the judgement wherever you live and that might be very hard for them to do, depending on which country you are planning to go.
