Herr Moser,

Thank you in advance for considering my question.

I was stationed in Germany and married a German woman in 1990.We had a son in 1992. We came back to the U.S. in 1993, but due to many problems - financial and emotional, she returned to Germany in 1995 with our son. In 1996, I was served divorce papers from a German court. I have since remarried to a U.S. citizen, and am the sole income for our home.

Every time I have called to speak with my son, I am verbally assaulted by my ex-wife until I end the call, most times without being able to speak to my only son. Letters and packages are generally not acknowledged either, and when I did try to send her money, she sent it back with a letter that she did not want or need my assistance. She has known of my location the entire time we have been apart, as I have never kept it hidden from her.

After 13 years, the Jugendamt in Frankfurt A.M. has sent me a form, a financial affidavit, for me to complete in German. My German is far too rusty to translate this, and it seems rather rude to me to send me documents that I cannot possibly be expected to know how to fill out.

Due to her not seeking and/or denying support for 13 years, am I facing the possibility of being forced to pay back support in addition to support in the future?

Hello Chris,

after such a long time and especially after your wife did not even accept child support when paid, you are not obligated to pay back support.
However, depending on your income you might however have a current obligation to pay child support.

The Jugendamt cannot force you to fill out their forms, but if you don't respond to them, they might sue you with the goal of obtaining this information.

My advice would depend on your financial situation and if you are willing to pay child support or not.
