Expert: Henning Haarhaus Date: 7/8/2008 Subject: Obligation in respect of a partners Debt
Question My partner (who is German) has a student loan that originated in Germany can am I liable in respect of his debt
Answer It depends to the matrimonial regime applicable to your marriage. This depends on the jurisdiction you both lived in when you married and on the agreements you have concluded with your spouse.
As the German statutory regime (applicable if you did not conclude otherwise) provides not the common property but the sharing of accrued gains only you would not be liable in this regard.
