Question
hello,
i am a german passport holder who got married to an indian in india 2 months ago. the marriage has been registered in india under the special marriage act.
i have not got this marriage registered in germany upto now.
he has visited germany on a tourist visa for about 3 weeks.
due to very personal reasons i would like to seek a divorce. question now is :
- is it possible in germany (if he is not there)
- if yes.. when and how can i do it
- right now for an indian divorce we have to wait one year for a mutual consent divorce - to which at this moment he is not ready

in india i have no chance of getting a divorce due to personal reasons. no matter how long i live separate from him.
thanks for your help

Answer
Hello,

you can get a divorce in Germany, but you would need to be separated for one year. So if you have stopped living together already, you will be able to obtain a divorce in one year.

Sorry, but there is really no quicker way.
